These Terms of Service govern your access to and use of TheHomeschoolingCompany, including our website, parent portal, learner dashboard, AI mentor, generated curriculum, diagnostics, schedules, progress tools, attendance tools, compliance document tools, transcripts, billing flows, and related services.

By creating an account, using the service, starting a trial, buying a subscription, inviting a learner or guardian, or allowing a learner to use the service, you agree to these Terms. If you are using the service for a minor, you represent that you are the minor's parent, legal guardian, or authorized adult and that you consent to the minor's use of the service.

1. The Service

TheHomeschoolingCompany provides software for homeschool planning, personalized learning, AI-assisted instruction, project generation, placement diagnostics, mentor support, progress tracking, attendance and recordkeeping, parent reporting, and draft compliance documents.

We are a software and curriculum-support service. Unless a separate written agreement says otherwise, we are not a public school, private school, accredited school, school of record, legal advisor, tax advisor, medical provider, therapist, or emergency service.

2. Parent Responsibility

3. Eligibility and Minor Users

Adults may create parent, guardian, or institution accounts. Learners under 18 may use the service only with permission and supervision from a parent, guardian, school, institution, or other authorized adult.

Children under 13 may not create or manage accounts on their own. A parent or guardian must create, supervise, or consent to any learner profile for a child under 13.

4. Accounts and Security

5. Acceptable Use

You may use the service only for lawful educational, homeschool, parent, learner, and institution-management purposes.

6. AI Features

The service uses AI to generate curriculum, projects, explanations, feedback, summaries, assessments, schedules, and draft records. AI systems can produce errors, omissions, biased output, unsafe suggestions, or content that does not fit your family, state, institution, or learner.

You are responsible for reviewing AI output before assigning it to a learner, submitting it to an authority, relying on it for a record, or using it for a high-stakes decision. We may monitor, filter, or block prompts and outputs to protect users, enforce these Terms, and improve reliability.

7. User Content and Learning Records

You retain ownership of the learner work, profile details, submissions, uploaded files, notes, and other content you provide to the service. You grant TheHomeschoolingCompany a limited license to host, process, display, analyze, transform, and use that content as needed to provide, secure, support, and improve the service.

AI-generated materials created for your account may be used by your family for personal homeschool purposes, subject to these Terms and third-party restrictions. We may reuse de-identified, aggregated, or generalized learnings to improve the product, but we do not sell learner personal information.

8. Payments, Trials, and Subscriptions

9. Institutions and Linked Accounts

Institutions, co-ops, schools, tutors, or other organizations may receive access to learner information only according to account permissions, guardian links, invitations, or a separate written agreement. The person creating or managing an institution account represents that they have authority to do so and to invite or manage the learners and adults connected to that account.

10. Intellectual Property

The service, software, user interface, prompts, workflows, designs, trademarks, logos, and platform content belong to TheHomeschoolingCompany or its licensors. These Terms do not transfer ownership of our platform or brand to you.

You may not copy, modify, distribute, sell, lease, or create competing services from our software, designs, prompts, or platform content except where law allows or we agree in writing.

11. Third-Party Services

The service depends on third-party providers for hosting, authentication, storage, analytics, payments, AI models, email, and other functions. Those services may have their own terms and privacy practices. We are not responsible for third-party services outside our control.

12. Service Changes and Availability

We may add, remove, change, suspend, or discontinue features as the product evolves. We try to keep the service reliable, but we do not guarantee uninterrupted access, error-free output, permanent storage of every generated artifact, or continued availability of every model, provider, plan, or feature.

13. Suspension and Termination

We may suspend or terminate access if we believe you violated these Terms, created risk for users or the service, failed to pay fees, infringed rights, or used the product unlawfully. You may stop using the service at any time and may request account deletion as described in the Privacy Policy.

14. Disclaimers

The service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.

We do not guarantee that a learner will achieve any specific academic outcome, test result, admission result, athletic eligibility result, legal compliance result, or acceptance of any document or transcript by a third party.

15. Limitation of Liability

To the maximum extent permitted by law, TheHomeschoolingCompany and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, educational outcomes, legal compliance outcomes, or third-party decisions.

To the maximum extent permitted by law, our total liability for claims relating to the service will not exceed the amount you paid to TheHomeschoolingCompany for the service in the three months before the event giving rise to the claim, or one hundred dollars if you did not pay us during that period.

16. Indemnity

You agree to defend, indemnify, and hold harmless TheHomeschoolingCompany from claims, damages, liabilities, costs, and expenses arising from your use of the service, your content, your violation of these Terms, your violation of law, or your infringement of another person's rights.

17. Changes to These Terms

We may update these Terms as the product, business, providers, or legal requirements change. When we make material changes, we will update the Last Updated date and, when appropriate, provide additional notice. Continued use after changes become effective means you accept the updated Terms.

18. Governing Law

These Terms are governed by applicable United States law and the laws that apply to TheHomeschoolingCompany's business location and organization, without regard to conflict-of-law principles, except where consumer protection law gives you non-waivable rights in another jurisdiction.
